User Agreement - Purchaser Agreement: User is granted permission to access the specific areas
of the ddssratings.com site and/or DDSS Ratings for the specific period indicated on the purchaser
invoice, subject to the following terms and conditions:
User agrees that in the event of an interruption of service, unforeseen or
otherwise, User will be granted an extension of the duration of his or her
purchase equal to the duration of the interruption of service.
ddssratings.com agrees to exercise reasonable diligence in producing the daily
ratings in a timely manner, and in notifying User in advance of interruptions of
service when possible. The sole obligation and liability of ddssratings.com in any
interruption of service shall be to provide User with one additional day of ratings
for each day the service is interrupted, with such additional days being added to
the duration of User's purchase.
1) User agrees that the information and ratings published on the ddssratings.com website and/or DDSS
Ratings are for informational purposes only, and are not an inducement to wager or invest. Any personal
use of the contents of the ddssratings.com website and/or DDSS Ratings for other than informational
purposes is at the sole discretion and responsibility of the purchaser.
2) User agrees that access to the ddssratings.com website and/or DDSS Ratings is granted on an
individual basis to the User, and agrees not to share, publish, disseminate, or reveal the
contents of the ddssratings.com website to any other person or persons in any manner whatsoever, including,
but not limited to, re-publication or posting of any part of the content of the ddssratings.com website
and/or DDSS Ratings on any other website, or by any form of written or electronic communication.
3) ddssratings.com agrees to exercise reasonable care in publishing information and ratings and User agrees
to hold ddssratings.com and principals thereof harmless for any direct or indirect losses sustained by User
that result from inaccurate, missing, or incomplete information, occasional errors and omissions that may
occur as a result of incorrect data received from others, errors in processing, or other causes.
4) ddssratings.com expressly disclaims liability for any use of the content of the ddssratings.com website
and/or DDSS Ratings for other than informational purposes, including any direct or indirect losses
sustained by User as the result of actions that are in violation of the terms and provisions of this
agreement. In no event shall the liability of ddssratings.com or the principals thereof exceed
the amount of U.S.$5.00.
5) Any use of the contents of the ddssratings.com website and/or DDSS Ratings for any commercial
purpose, or in conjunction with any commercial enterprise, including, but not limited to,
re-publication or posting of any part of the content of the ddssratings.com website and/or DDSS Ratings on
any other website, or by any form of written or electronic communication, or integration of
the content of ddssratings.com website and/or DDSS Ratings into any other commercial application of any
type, or use of the content of ddssratings.com website and/or DDSS Ratings for any purpose other than
those granted to User by this agreement is expressly forbidden.
6) The use of any robot, spider or other automated means to access and/or extract the content of this
site is prohibited.
7) Re-publication, re-transmission or dissemination of the contents of this website, in any form, is
prohibited without the express written permission of ddssratings.com.
8) User agrees that violation of any part of this agreement by User is sufficient and reasonable cause
for immediate cancellation of User memberships and access to the ddssratings.com website, to the
content of ddssratings.com website and/or DDSS Ratings, denial of access to further DDSS Ratings
of any type, forfeiture of any unused portion of memberships fees paid in advance, and possible
legal action against User by ddssratings.com.
9) User agrees that in the event of violation of any part of this agreement by User, User will reimburse
ddssratings.com for any and all reasonable legal fees and court costs incurred by ddssratings.com that may
result, directly or indirectly, from User's violation of the terms and conditions of this agreement.
10) User agrees that the material and content of the ddssratings.com website and/or DDSS Ratings
website may be inappropriate for children or minors. User agrees to take any and all reasonable
precautions necessary to prevent the material and content of the ddssratings.com website and/or DDSS
Ratings from being viewed or accessed by anyone under 21 years of age.
11) This Agreement shall be binding upon the parties, their successors, legal representatives, and
permitted assigns.
12) The laws of the State of Minnesota, USA, applicable to agreements executed and performed wholly
within Minnesota, shall govern the validity, interpretation, and enforcement of this agreement. It is
expressly agreed to by and between the parties hereto and any other person or persons seeking to utilize
the services provided for hereunder, that any lawsuit brought against ddssratings.com shall be commenced
and adjudicated only in the United States District Court for the State of Minnesota, or in Minnesota State
Courts located in Hennepin County, Minnesota.
13) If any provision of this Agreement or its application is held to be invalid, illegal, or unenforcable in any
respect, the validity, legality, and enforceability of any of the other provisions and applications herein
shall not in any way be affected or impaired and any provision held to be invalid, illegal, or unenforceable
shall be replaced with an enforceable provision of like intent or effect.
